The petitioner seeks bail in Dumraon (N.B.) P.S. case No. 289 of 2016 under Section 25(1-b) a/ 26/35 of the Arms Act. The police on suspicion arrested the petitioner and one Anirudh Ram @ Chhotu. From the possession of petitioner loaded country made pistols with live cartridges and Rs. 50,000/- were recovered.

The learned counsel for the petitioner submits that money was not subject matter of the present case and for the recovery of arms and ammunitions the petitioner is in jail since 05.11.2016 but from perusal of the records, it appears that petitioner has got criminal antecedent and he is accused in as

Patna High Court Cr.Misc. No.10952 of 2017 (3) dt.04-04-2017 2/2 many as nine cases under different Sections of the Arms Act and under Sections 392, 395 and 396 of the IPC.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the same is rejected.
