JUSTICE BIRENDRA KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/149/341/ 323/307 /325 /302/504 of the Indian Penal Code.
For dispute relating to measurement of land between two neighbours, occurrence of assault was allegedly committed by the petitioner and others, which resulted in injury and later on death of the husband of the informant. Submission of the petitioner is that the allegation is general and omnibus. The counter case as well as injury report of counter case would reveal that petitioner had sustained stab injury on the abdomen during the same occurrence. Petitioner is in custody
Patna High Court Cr.Misc. No.11315 of 2017 (3) dt.12-04-2017 2/2 since 17.12.2016.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Mahnar, Vaishali/Successor Court, in connection with Mahnar P.S. Case No.70 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
