The petitioner seeks bail in connection with Fatuha P.S. Case No.798 of 2021, registered for the offence punishable u/s 30 (a), 56 (c) of the Bihar Prohibition and Excise Act. Earlier, vide order dated 06.09.2022 passed in Cr. Misc. No.28782 of 2022, the learned counsel for the petitioner himself withdraw the anticipatory bail application. The petitioner has now filed this second application for bail.

Having gone through the submissions of the parties and on perusal of the bail application, I find that there is no bar to file a second anticipatory bail application in the criminal

Patna High Court CR. MISC. No.19268 of 2023(2) dt.29-03-2023 2/2 proceedings, but considering this fact that the learned counsel for the petitioner has himself withdrawn the earlier anticipatory bail application, therefore, I am not inclined to entertain the present anticipatory bail application, as such, the prayer for bail is rejected.
