2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 8(b), 18, 29 of the NDPS Act.

3. It is alleged that 11 packets of smack were recovered from the pocket of the co-accused Rohit Kumar who was apprehended on the spot, who disclosed the name of this petitioner.

4. It is submitted on behalf of this petitioner that he has been made accused in this case only on the basis of confessional statement of co-accused Rohit Kumar. Petitioner was not present at the place of occurrence and has got no concern with the co-accused Rohit kumar. No incriminating

Patna High Court CR. MISC. No.15492 of 2024(4) dt.08-05-2024 2/2 article has been recovered from the possession of the petitioner. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (NDPS), Patna in SPL (NDPS) Case No. 138 (A) of 2022 arising out of Maner P.S. case No. 536 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
