2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 366A/34 of the Indian Penal Code and sections 8 and 10 of the POCSO Act.

3. As per the prosecution case, this petitioner assisted co-accused Manjit Kumar in kidnapping of daughter of the informant.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Specific allegation of kidnapping is against co-accused Manjit Kumar who has already been acquitted in trial vide judgment dated 22.5.2024, passed in

Patna High Court CR. MISC. No.10621 of 2025(3) dt.08-05-2025 2/2 POCSO Case No. 5/2024.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Additional Sessions Judge POCSO, Saran at Chapra in Garkha Police Station Case No. 179/2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
