JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 353, 435, 427 and 504 of the Indian Penal Code. The prosecution case is that the informant's jeep met with an accident as a result one person died while others were injured. On the accident site, nine FIR named persons and 70-80 unknown gathered and misbehaved with the police and set the police jeep on fire.
It is submitted by learned counsel for the petitioners that the informant being a private person lodged the present case to
Patna High Court Cr.Misc. No.3570 of 2016 (2) dt.22-01-2016 2/2 save his own skin. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation against the mob, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Kiul in connection with G.R.P. Kiul P.S. Case No. 134 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
