JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 304B/120B/201 of the Indian Penal Code.

Petitioner is husband of the victim lady, who died within two years of her marriage in unnatural circumstances. There is allegation of demand of dowry and torture for the same. Submission is that the victim committed suicide due to some quarrel with her husband at Kolkata. The land-dady stated before the police that there was cordial relation between the two.

Learned Additional Public Prosecution submits

Patna High Court Cr.Misc. No.11311 of 2017 (3) dt.29-03-2017 2/2 that the case-diary reveals that no one has supported the allegation of demand of dowry and torture for the same.

Considering the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Divya Prakash, learned Judicial Magistrate, 1st Class, Saran at Chapra/Successor Court, in connection with Ekma P.S. Case No.32 of 2012, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
