JUSTICE BIRENDRA KUMAR ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 379 of the Indian Penal Code. The offence alleged is theft of motorcycle by unknown person.
Submission is that nothing has been recovered from the possession of this petitioner. His name surfaced in the confessional statement of co-accused.
Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
