The petitioner, who is in custody, seeks bail in connection with Sasaram Nagar P.S.Case No. 1159 of 2016 registered under Sections 380, 454 and 511 of the Indian penal Code.

Allegation is that the petitioner was apprehended red handed by a lady in the house of the informant at 2:30 PM in day hours when he was breaking the lock of a box. It is submitted that it is highly improbably that anyone can make attempt of theft in day hours and nothing has been stolen by the petitioner from the house of the informant and he has no criminal antecedent.

Having considered the aforesaid facts and

No.6661 of 2017 (2) dt.15-02-2017 2/2 circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram Nagar P.S.Case No. 1159 of 2016.
