The petitioner is accused in connection with Chakia P.S. Case No. 137 of 2015 registered under Section 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report as on the basis of the written report of the informant Rahul Kumar Gupta, Chakia P.S. Case No. 137 of 2015 was instituted against unknown regarding theft of motorcycle. Later on, one Binod Kumar was apprehended by the Police with motorcycle in connection Ghorasahan (Jitna) P.S. Case No. 271 of 2015 which was
Patna High Court Cr.Misc. No.1550 of 2016 (3) dt.19-02-2016 2/2 instituted in which she has confessed his guilt and disclosed the name of petitioner about committing the theft of motorcycle and from the house of the petitioner the stolen motorcycle of the present case has been recovered. Further submission is that the petitioner has no criminal antecedent except Ghorasahan (Jitna) P.S. Case No. 271 of 2015 in which the petitioner is on bail. The petitioner is in custody since 18.08.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Motihari, East Champaran in connection with Chakia P.S. Case No. 137 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
