On trivial issue, as alleged by the informant Dharmendra Pandey, accused Sachidanand Pandey, Pintu Pandey, Munna Pandey, Sudhir Pandey, Dulari Devi, Tara Devi, armed with deadly weapon, made house trespass and assaulted the female members of the family, namely, Gayatri Devi, Neelam Devi, Binu Kumari, Kajal Kumari. During course thereof, accused Sachidanand Pandey gave iron rod below over head of Umashankar Pandey, as a result of which there has been fracture and became unconscious. He then was repeatedly assaulted.

From the injury report annexed with the diary, it is evident that Gayatri Devi as well as Asha Kumari have sustained superficial injury caused by hard and blunt substance. Further more, these petitioners did not have any kind of specific allegation with regard to assault over the deceased Umashankar Pandey.

Consequent thereupon, the petitioner, namely, Pintu Pandey, Sudhir Pandey and Munna Pandey, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawadah in Rajauli P.S.Case No. 282/2019.
