Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Rajauli P.S. Case No.439 of 2022 dated 23.08.2022 registered for the offence punishable under Section 414 of the Indian Penal Code.

The main submissions advanced by the learned counsel for the petitioner are that as per the allegation the petitioner purchased one motorcycle which is stated to be stolen and except this there is no any other allegation against him and he has been dragged in this matter due to village politics and he has been languishing in jail since 22.12.2022 and against him there is criminal antecedent of one case in which he

Patna High Court CR. MISC. No.15246 of 2023(2) dt.29-04-2023 2/2 is on bail and one co-accused namely Sadhu Yadav against whom there is similar nature of allegation, has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.3197 of 2023 and against the petitioner the investigation has been completed.

Learned APP appearing for the State has opposed the bail prayer.

Considering the above submissions, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Rajauli P.S. Case No.439 of 2022.
