Learned counsel for the appellant submits that the matter has been compromised by the appellant and the respondents in Execution Case No. 183 of 2024 pending in the Court of Additional District and Sessions Judge-I, Patna for execution of the Award dated 28.03.2018 passed by learned Court below in Claim Case No. 3458 of 2014.

3. As per the compromise, the respondents herein (claimants before the Court below) have agreed to take Rs.18,00,000/- towards full and final settlement, in regard to the

Patna High Court MA No.704 of 2018(11) dt.23-09-2025 2/2 Award.

4. Hence, learned counsel for the appellant is seeking permission to withdraw the present petition.

5. Permission is accorded.

6. Accordingly, the present petition is dismissed as withdrawn.

7. At this stage, learned counsel for the appellant is also praying for refund of the statutory amount of Rs.25,000/- deposited in the office at the time of filing of the Miscellaneous Appeal.

8. Learned counsel for the respondents have no objection to this.

9. Hence, office is directed to return the statutory amount of Rs.25,000/-, paid by the appellant at the time of filing of the appeal.

10. Accordingly, the present petition stands disposed of.

11. L.C.R. be sent back to the Court concerned forthwith.
