JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P for the State. The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 341, 342, 323, 379, 498A, 504, 506 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of cruelty and torture for non-fulfillment of dowry demand and ousting the informant from her matrimonial house.
It is submitted by learned counsel for the petitioner that petitioner tried his best to resume the conjugal life but it is the informant who does not want to live with the petitioner. The petitioner is still ready to keep the informant as

Learned counsel appearing on behalf of the informant has submitted that torture has been inflicted upon the informant by the petitioner and her in-laws family members. However, the informant is still ready to live with the petitioner as wife, provided the petitioner keeps her with dignity and honour.
Considering the present stand of the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Purnea in connection with Amour P.S. Case No. 188 of 2021. At the time of filing bail bonds, the petitioner shall appear before learned Court below along with his wife, informant/O.P. No. 2. The learned Court below shall accept the bail bonds of the petitioner after satisfying from the informant/O.P. No. 2 that petitioner is keeping her as wife with full dignity and honour. The informant will be at liberty to file appropriate application before learned Court below for cancellation of bail bonds of the petitioner, if the petitioner fails
