JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-04-2023 Though the present writ petition has been filed seeking quashing of the enquiry report dated 18.06.2015, submitted by the Deputy Superintendent of Police (Vigilance Cell) to the Deputy Secretary, Office of the Lokayukta, Bihar, Patna but considering the fact that the same is only a preliminary report, which is required to be considered by the learned Lokayukta and accordingly he has to proceed further in
Patna High Court CWJC No.19669 of 2016(2) dt.10-04-2023 2/2 the matter, the learned counsel for the petitioner submits that the petitioner be granted liberty to approach the Office of the Lokayukta, Bihar, Patna to ascertain as to whether any order has been passed by the learned Lokayukta, Bihar, Patna and in case, any adverse order has been passed against the petitioner, he be granted liberty to assail the same.
Having regard to the limited submission made by the learned counsel for the petitioner, I deem it fit and appropriate to grant liberty to the petitioner to approach the office of the Lokayukta, Bihar, Patna and in case, any order has been passed by the Lokayukta, Patna, in pursuance to the enquiry report dated 18.06.2015, the same shall be handed over to the petitioner, within a period of 48 hours, of the petitioner making appropriate application.
It is needless to state that the petitioner shall be at liberty to challenge any adverse order passed against him by the learned Lokayukta, Bihar, in accordance with law. The writ petition stands disposed off on the aforesaid terms.
