The petitioner seeks bail in Maniyari P.S. Case No. 09/2017, registered for the offences punishable under Sections 399, 402, 414, 120(B) of the Indian Penal Code and sections 25(1b)a, 26(ii) and 35 of the Arms Act and sections 20, 22 of the N.D.P.S. Act.
The informant S.H.O. of Maniyari P.S. on secret information, arrested Vikash Kumar @ Mohantha, Sandip Kumar Jha and Udit Jha @ Sona Babu who are said to have disclosed that on 09.01.2017 they committed dacoity and handed over the looted article to Rajnish Kumar @ Raja Babu. Rajnish Kumar @ Raja Babu confessed his guilt and disclosed that he kept the looted article 'Matar Pulse' in the house of the petitioner Vijay Das.
Patna High Court Cr.Misc. No.19185 of 2017 (3) dt.19-06-2017 It is submitted that on the same day, the house of the petitioner was searched and 50 bags each containing 50 k.g. of 'Matar Pulse' were recovered. The petitioner did not take part in the crime. Raja Babu happens to be the relative of the petitioner who kept 'Matar Pulse' in the house of the petitioner. The petitioner is in jail since 14.01.2017.
Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Maniyari P.S. Case No. 09/2017.
