The petitioner seeks bail in connection with Rasulpur P.S. Case No.146 of 2019 registered under Sections 399, 402 and 414 of the Indian Penal Code besides Sections 25(1-b) a, 26 and 35 of the Arms Act.

The accusation is that on receiving secret information about gathering of the miscreants at Chapraithi Dam for preparation of committing dacoity, the informant along with other police personnel, who were on patrolling duty, proceeded for there. On seeing the police party, the persons present there started to flee away but, on chase, Haribhuan Choudhary, Mantoo Kumar Ram (petitioner), Raushan Kumar Ojha and Anuj Kumar Singh were apprehended, who also disclosed the name of their associates, who

On search, Haribhuan Choudhary was found in possession of cash of Rs.20,000/-, one mobile set and one tab, whereas the petitioner was found in possessions of one country made pistol, one live cartridge, one mobile set and cash Rs.10,000/-, Raushan Kumar Ojha was found in possession of one loaded country made pistol, one live cartridge and cash Rs.10,000/- and Anuj Kumar Singh was found in possession of one mobile set and cash Rs.14000/-. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and is in custody since 01.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, Saran at Chapra, in connection with Rasulpur P.S. Case No.146 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner.
