JUSTICE BIBEK CHAUDHURI ORAL ORDER 08-01-2025 The petitioner is a police officer in the year 2023, he was posted as Station House Officer, Kargahar Police Station in the District of Rohtas. Being aggrieved by an order dated 13th January 2023 passed under Section 82 and 83 of the CrPC directing the petitioner to execute the warrant of proclamation and attachment issued against the accused Rajendra Dom and imposing him a cost of Rs. 5,000/- for non compliance of earlier order. The petitioner approached in revision before this Court. At the time of hearing, it is submitted by the learned Advocate for the petitioner that Session Trial No. 340 of 1993 in which the impugned order was passed was disposed of by the Learned First Additional District & Sessions Judge, Sasaram Rohtas by judgment dated 22nd May 2023, whereby acquitting

Patna High Court CR. REV. No.119 of 2023(4) dt.08-01-2025 2/2 the accused under Section 232 of the CrPC. It is also found from the copy of the said order that Rajendra Dom against whom the order of proclamation and attachment was issued subsequently surrendered before the Court to face trial. As the criminal case ended in acquittal, the impugned order does not have any force. Accordingly, the instant criminal revision become infructuous and the same is disposed of.
