2. The petitioner has filed the instant application for the following reliefs :- "(i) For directing Respondent No. 4 (Sasaram-Bhabhua Central Co-operative Bank

Patna High Court CWJC No.3469 of 2026(2) dt.18-03-2026 2/3 Ltd.) to immediately restore and sanction CashCredit facility to PACS Hurka, as the Petitioner has fulfilled all safeguard conditions prescribed by the Registrar, NABARD, and RBI, and denial thereof violates the doctrine of legitimate expectation (FCI v. Kamdhenu, (1993) 1 SCC

71) and Article 14 of the Constitution.

(ii) For directing the Respondents to extend all cooperative entitlements i.e., go-down construction, tractor subsidy, and fertilizer-loan facilitiesto PACS Hurka without discrimination, as denial to an innocent committee is arbitrary, disproportionate, and violative of Articles 14, 21, and 39(b) of the Constitution.

(iii) To hold and declare that the Respondents' refusal to act on the Petitioner's safeguard proposals, despite compliance and binding directives, constitutes breach of statutory duty under Sections 36, 41, and 82 of the Bihar Co-operative Societies Act, 1935, and infringes the Petitioner's rights under Articles 19(1)(g) and 21, as held in Maneka Gandhi v.

Union of India, AIR 1978 SC 597.

(iv) For any other relief/s for which these Petitioners be found entitled in the eye of law."

3. Learned counsel for the petitioner in reference to the statement made in paragraph no.21 of the writ application submits that on 3.1.2025, the petitioner has already moved before the Registrar, Cooperative Societies, Bihar with respect

Patna High Court CWJC No.3469 of 2026(2) dt.18-03-2026 3/3 to the grievances raised by the petitioner in the instant application. It is submitted that the writ application be disposed of giving a direction to the Registrar, Cooperative Societies, Bihar to decide the said representation/petition within a reasonable time.

Having heard learned counsel for the parties and taking into consideration the contents of the petition, the writ application is disposed of with a direction to the petitioner to file a fresh application/petition/case before the Registrar, Cooperative Societies, Bihar, which on being filed shall be registered and decided in accordance with law by the respondent concerned at the earliest preferably within a period of six months from the date of its filing.

5. The writ application stands disposed of with the above observations and directions.
