Case No. 218 of 2019, registered for the offence punishable under Section 30(d) of Bihar Prohibition and Excise Act. Allegation is of recovery of 1000 kg. of mahua flower from a pickup van and petitioner happens to be driver of the van.

Submission of learned counsel for the petitioner is that he is only driver and has nothing to do with the seized article and he is in custody for more than three months and charge sheet has been submitted, as such there is no chance of tampering with the evidence.

Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.8677 of 2020(2) dt.28-02-2020 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Gaya, in connection with Amas P.S. Case No. 218 of 2019. (Vinod Kumar Sinha, J) spal/- U T
