It appears that name of the petitioner came in the confessional statement of co-accused Mukesh Kumar against whom charge sheet was submitted and investigation in respect of the petitioner was kept pending. Subsequently, statement of In-charge Headmaster, namely, Kumkum Kumari was recorded and the aforesaid witness named the petitioner.
Petitioner carries criminal antecedent but submission on behalf of the petitioner is that having more or less similar allegation co-accused Mukesh Kumar Mahto @ Mukesh Kumar has already been granted privilege of bail and so far statement of In-charge Headmaster, Kumkum Kumari, is concerned, the same is nothing but only highhandedness of the police.
Considering the aforesaid facts and circumstances as well as
Patna High Court Cr.Misc. No.772 of 2016 (2) dt.11-01-2016 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri S.C. Kumar, Judicial Magistrate, Ist Class, Nawada/ concerned court in Warisaliganj P.S. Case no. 18/2015.
