JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 05-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 25 (1-b)a, 26, 35 of the Arms Act and section 20/22 of the Narcotic Drugs and Psychotropic Substance Act, 1985.

On information, the police raided the lodge of Dhiraj Kumar. On seeing the police party, one of the co-accused person started running away. On chase, he was apprehended by the police and from the search of the room of the petitioner, a

Patna High Court CR. MISC. No.10571 of 2022(2) dt.05-07-2022 2/3 country-made pistol and 100 gram Ganja were recovered. The petitioner used to sell cartridge.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case as he is a student of polytechnic. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has also criminal antecedent of one case after institution of this case. He further submitted that other students also come and go in the said room. The petitioner is in custody since 02.10.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, NDPS Act, Nalanda, in connection with Deepnagar P.S. Case No. 345 of 2021, with following conditions :-

1. One of the bailors must be a close relative of the petitioner.

2. The petitioner is directed to remain physically

Patna High Court CR. MISC. No.10571 of 2022(2) dt.05-07-2022 3/3 present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be cancelled.

3. If the petitioner is found involved in any other criminal case in future, his bail bond is liable to be cancelled. The application stands allowed.
