The petitioner apprehends her arrest in Nayagaon P.S. Case No. 21 of 2016 instituted for the offence under Section (s) 409 of the Indian Penal Code. As per the written report, there is specific allegation of misappropriation of money against Anil Kumar Patel as In-charge, Headmaster of the school. This petitioner is said to be the Secretary of the aforesaid school.
It has been submitted on behalf of the petitioner that Anil Kumar Patel has filed an affidavit in the Court below that he would deposit the entire defalcated amount. The said Anil Kumar Patel has already deposited Rs. 25,00,000/- and filed
Patna High Court Cr.Misc. No.10720 of 2017 (2) dt.18-03-2017 2/2 undertaking to deposit rest of the amount within two-three months as appear from the order of the Sessions Judge. It also appears from the order of Sessions Judge that name of this petitioner has come during supervision by the Supervising Authority as Secretary of the aforesaid school.
It has been mentioned in para 3 of the petition that petitioner has clean antecedent.
In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Nayagaon P.S. Case No. 21 of 2016, she shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Begusarai, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
