JUSTICE SANDEEP KUMAR ORAL ORDER 03-02-2022 Heard Mr. Alok Kumar Choudhary, learned counsel for the petitioner and Mr. Sanjay Kumar Verma, learned counsel for the opposite party No. 2 including learned Additional Public Prosecutor for the State through video conferencing. The petitioner apprehends his arrest in connection with Complaint Case No. 1540/2018 registered for the offences punishable under Sections 498-A of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act. It has been jointly submitted by the petitioner and the opposite party No. 2 that the matter has been settled between the

Patna High Court CR. MISC. No.8626 of 2020(5) dt.03-02-2022 2/2 parties and steps have been taken by them pursuant to the settlement.

Learned counsel for the petitioner submits that a demand draft of Rs. 5.3 Lakhs has already been deposited in the court below as per the terms of the compromise and so far as the other terms and the conditions of the compromise are concerned, they are also being honoured by the parties. Considering the facts and circumstances of the case, the present anticipatory bail application is allowed. Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of ten weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Complaint Case No. 1540/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
