The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
As per prosecution case, in brief, informant who conducts CSP of ICICI Bank alleged that on 24.01.2022, when was at a medicine shop having bag of withdrawn money total Rs. 2 lakh 60 thousand, in the meantime, two miscreants riding one motorcycle came and snatched his money containing bag and fled away. Thereafter, this case has been lodged.
Patna High Court CR. MISC. No.12274 of 2023(2) dt.24-04-2023 2/3 Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of confessional statement of co-accused. Neither petitioner is named in the FIR nor he has been put on TIP till now and no any looted money has been recovered from his conscious possession. Similarly situated co-accused has already been granted bail by this Court vide order dated 21.03.2023 passed in Cr. Misc. No. 73752 of 2022. It is further submitted that the petitioner is remanded in this case from another case and since then he is languishing in judicial custody (22.10.2022).
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Town P.S. Case No. 64 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
