ANJANA MISHRA ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is custody since 13.07.2015 in connection with a case registered for the offences punishable under Sections 457/380 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is not named in the First Information Report yet on the basis of confessional statement made by a co-accused certain recoveries are alleged to have been made from his possession. It is submitted that another similarly situated person namely Raja Sahani, who was also similarly implicated and certain mobile phones were recovered from his possession, has been extended the privilege of regular bail by this Court vide order dated 17.12.2015

Patna High Court Cr.Misc. No.157 of 2016 (3) dt.05-02-2016 P2/2 passed in Cr. Misc. No. 42150 of 2015.

Considering the aforementioned facts and circumstances, the period of custody and that the articles had not been put on Test Identification Parade, let the petitioner Guli Sah be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S. Case No. 530 of 2015. (Anjana Mishra, J) Saif/- U T
