2. The petitioner has preferred this application for grant of regular bail in connection with Bibhutipur P.S. Case No. 423 of 2025 registered for the offences punishable under Sections 25(1-B) (a), 26 of the Arms Act.
3. As per the prosecution case, one country made pistol was recovered from the house of the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case at the instance of local people who were on inimical term with the petitioner due to on going election. It has also been submitted that the procedure prescribed under Section 103
Patna High Court CR. MISC. No.11299 of 2026(5) dt.06-05-2026 2/2 of the B.N.S.S. has not been followed. Lastly, it has been submitted that the petitioner has got two criminal antecedents in which he is on bail and is in custody since 30.10.2025.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

Heard the parties and perused the record, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur, in connection with Bibhutipur P.S. Case No. 423 of 2025.
7. The application stands allowed.
