This application is for grant of bail in connection with Rajgir P.S.Case No.100 of 2013 for the offence under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code. It is submitted on behalf of the petitioner that earlier he had been granted bail by this Hon'ble Court, which will appear from Annexure-1, vide order dated 21.3.2014 passed in Cr. Misc. No.3747 of 2014 but he could not surrender within the period, as specified in the above order, and now he has surrendered in January, 2017 and since then, he is in custody. Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of the fact that in spite

No.14568 of 2017 (2) dt.30-03-2017 2/2 of direction of this Court, he has not surrendered for three years, as such, I am not inclined to grant bail to the petitioner, however, this petitioner may renew his prayer for bail before the court below concerned, after framing of the charge and the learned court below will consider the fact that earlier he had been granted anticipatory bail by this Hon'ble Court and he will also pass appropriate order without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed at this stage.
