Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Sadar P.S. Case No. 09 of 2019, registered for the offences punishable under Sections 384, 386, 387 and 120B of the Indian Penal Code.
Petitioner is alleged to have demanded Rangdari of Rs. 80 lakhs from the informant on his company's mobile and also threatened him. It is further alleged that petitioner demanded Rangdari several times by different numbers. It is submitted that petitioner has been falsely
Patna High Court CR. MISC. No.11546 of 2020(3) dt.29-06-2020 2/2 implicated in this case. Petitioner is not named in the FIR. There is no allegation against this petitioner. Petitioner is younger brother of FIR named accused Rinku Pathak @ Rajnish Pathak. There is contractual dispute between the informant and the brother of petitioner. Petitioner has got clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sadar P.S. Case No. 09 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
