JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 18.9.2015 in a case registered for the offences punishable under Sections 399 and 402/34 of the Indian Penal Code, sections 25(1-B) a, 26 (II) and 35 of the Arms Act and sections 20 and 22 of NDPS Act. On information that the miscreants are preparing to commit dacoity, raid was laid when from the possession of the petitioner one loaded country made pistol and one revolver loaded with three cartridges of which one was found to be live, were recovered. From other accused persons also arms and psychotropic substances were recovered.
Considering the nature of recovery and the criminal antecedent of the petitioner, this court is not inclined to grant bail
Patna High Court Cr.Misc. No.57667 of 2015 (3) dt.22-01-2016 2/2 to the petitioner at present in connection with Maniyari P.S. Case No. 206 of 2015 pending in the court of learned Sessions Judgecum-Special Judge, Muzaffarpur. This application is, accordingly, dismissed.
However, the petitioner will be at liberty to renew his prayer for bail after remaining in custody for nine months. (Dinesh Kumar Singh, J) Anil/- U T
