Under memo no. 4321 dated 6.4.2016 issued by Deputy Secretary in the Rural Works Department, petitioner's claim for grant of benefits under ACP/MACP has been forwarded to the Engineer-in-Chief-cum-Additional Commissioner -cum- Special Secretary, Road Construction Department.

Counsel for the petitioner submits that in spite of such claim having been forwarded the officials of the Road Constructing Department are not taking any decision for grant of third MACP which became due to the petitioner on

Patna High Court CWJC No.2062 of 2016(2) dt.30-01-2019 2/2 20.12.2012.

Counsel for the petitioner submits that the petitioner would be submitting a detailed and comprehensive claim highlighting his eligibility for grant of the same with effect from 20.12.2012 before the Engineer in Chief -cum- Additional Commissioner -cum- Special Secretary, Road Construction Department, Bihar, Patna (respondent No. 1).

In view of such submission this writ petition is disposed of with a direction to respondent No. 1 to dispose of the petitioner's claim on its own merit and eligibility expeditiously without any delay. The exercise should be completed within three months from the date of submission of petitioner's claim, which should be submitted within two weeks from today.

The writ petition is disposed of.
