The petitioner is apprehending his arrest in connection with Shahkund (Sajour) P.S. Case No.177 of 2018 (G.R. No.4235 of 2018) registered for the offence punishable under Sections 147, 148, 149, 323, 307, 354 and 379 of the Indian Penal Code.

As per the FIR, the petitioner has assaulted by iron road on the head of the complainant-informant. As the cause of the dispute is the previous enmity between the parties. There is specific allegation against the petitioner.

In such view of the matter, this Court refuses to grant the anticipatory bail, however, if the petitioner himself surrender before the Court below within three weeks from today and pray

Patna High Court CR. MISC. No.9577 of 2019(3) dt.11-03-2019 2/2 for regular bail, the Court below without being prejudiced this order will decide the case of the petitioner on its own merit on the same day.

Accordingly, this bail petition is dismissed with the aforesaid observation.
