The petitioner apprehends his arrest in connection with Brahampura P.S. Case No. 42/2013 registered for offences punishable under Sections 341, 323, 504, 506, 308, 307, 384, 427, 34 of the Indian Penal Code.
It is contended that though the petitioner is named in the first information report but there is no specific allegation against him except that he was also accompanying the three accused persons. Two of them, namely, Mitho Ram and Banti were demanding extortion money and Toffi Ram had assaulted the informant by rod. It is contended that petitioner's antecedent is clean and the first information report has been lodged after ten

Having regard to the facts and circumstances of the case, let the petitioners, namely, Kunal Kumar be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Brahmpura P.S. Case No. 42 of 2013, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
