2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 406 of the Indian Penal Code.
3. As per complaint case, mother of the complainant along with all the accused persons including this petitioner sold the land of her share to one Vijay Prasad.
4. Learned counsel for the petitioner submits that petitioner is sister of the complainant and she only identified mother who executed the sale deed in favour of Vijay Prasad and Bajainti Devi. Petitioner is neither vendor nor vendee of the land in question and she has got no concern with the alleged
Patna High Court CR. MISC. No.11627 of 2025(2) dt.21-03-2025 2/2 offence. Moreover, the dispute is of civil nature. Petitioner is lady and claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Gaya in connection with Complaint Case No. 516 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
