This application has been filed for modification of order dated 01.12.2021 passed in Cr.Misc. No. 60639 of 2021 to the extent of granting time for making payment of rest amount. Learned counsel for the petitioner submits that petitioner has already deposited Rs. 3,27,716/- on 20.03.2022 by the Bank draft and subsequently, he has deposited Rs. 25,000/- - 25,000/- in two times in the account of the PACS and as such, Rs. 9,33,144/- is remained to be deposited. Learned counsel for the petitioner requests for depositing entire rest amount in one installment within four months.
Patna High Court CR. MISC. No.16077 of 2023(2) dt.22-03-2023 2/2 In view of aforesaid facts and circumstances, further time till four months from today is granted to the petitioner to deposit the entire rest amount in one installment into the account of PACS, failing which, the learned court below would be at liberty to take coercive step against this petitioner. Accordingly, order dated 01.12.2021 passed in Cr.Misc. No. 60639 of 2021 is modified to the above extent only and this modification petition is allowed.
