The petitioner is apprehending his arrest in connection with Complaint Case No.2429 of 2011 dated 18.10.2011 , registered for offences punishable under Sections 406, 420, 120B and 504/34 of the Indian Penal Code.

Complaint petition disclosed the allegation against the petitioner and other co-accused persons that the petitioner showing him as the Chief Managing Director of Alokik Direct Marketing Pvt. Ltd. Disclosed the names of different schemes and invited for depositing money in the scheme and said that on investment of Rs.3100/- he will give articles of Rs.1,000/-

Patna High Court CR. MISC. No.11486 of 2019(4) dt.10-05-2019 2/3 and for rest after completing of chain of 40 persons he will get Rs.1,000/- monthly and on completion of chain of 80 persons he will get Rs.200/- per month and after completion of chain of 81920 people he will get Rs.54,000/- per month and thereafter he invested Rs.3100/- and by that ways he has collected money of Rs.3100/- and except Pant, Shirt and Sari of Rs.1,000/- nothing was paid to him and later on he has closed the website and refused to pay the amount.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and he is not Managing Director and the allegation is against the petitioner and one more accused person.

Heard learned A.P.P. also.

In this regard, notice was issued to the O.P.no.2 but it appears that in spite of service of notice nobody appears on behalf of O.P.no.2.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/-

Patna High Court CR. MISC. No.11486 of 2019(4) dt.10-05-2019 3/3 (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Complaint Case No.2429 of 2011, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
