Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 366A read with 34 of the Indian Penal Code As per prosecution case, the petitioner and co-accused kidnapped the daughter of the informant for the purpose of marriage.

Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in

Patna High Court CR. MISC. No.10560 of 2022(3) dt.27-07-2022 2/2 this case. Learned counsel for the petitioner has further submitted that the main allegation is against the co-accused Manoj Yadav who has already been granted bail by Coordinate Bench of this Court vide order dated 27.09.2021 passed in Cr. Misc. No. 28869 of 2021. The petitioner is also accused in one more case as stated at para 3 of the bail petition. The petitioner is in custody since 05.12.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VIIth-cum-Special Judge (POCSO), West Champaran, Bettiah, in connection with Bagaha Mahila P.S. Case No. 62 of 2019.

The application stands allowed.
