This application is for grant of bail in connection with Barauni (Chakiya) P.S.Case No.183 of 1992 for the offence under Section 216 of the Indian Penal Code.

It is submitted on behalf of the petitioner that though it is a case of misuse of the privilege of the bail, however, this is a case of 1992. The bail bond of the petitioner was cancelled in the year, 2013 and till the year, 2013, the petitioner appeared in the case and made pairvi but thereafter, he gone out of the State for earning his livelihood and his bail bond was cancelled on 20.06.2013. He has surrendered on 29.01.2017 and he is in custody since then. Heard learned A.P.P. also.

Having heard both sides and in view of the fact that it is the

Patna High Court Cr.Misc. No.12983 of 2017 (3) dt.28-03-2017 2/2 case of misuse of the privilege of the bail for four years, at this stage, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and once the charge is framed, the petitioner may move for bail before the court concerned, which will be considered by the learned court below itself.

With the aforesaid observation, this application is dismissed.
