This is a petition for grant of regular bail for offences under Sections 414 of the Indian Penal Code and 8 and 20(B)(ii)C of the Narcotic Drugs and Psychotropic Substances Act.
On two vehicles 93 Kilograms ganja was recovered and the named accused persons were apprehended. Allegation is that co-accused, Amod Kumar Rai, was escorting the vehicles. However, he met with an accident and fell down from the bridge. Thereafter, the petitioner and others, who were residents of nearby area, took him for treatment and Amod Kumar Rai was apprehended. The petitioner and others reached for the help of the persons, who were apprehended by the police there.
Considering the fact that there is no allegation
Patna High Court Cr.Misc. No.8608 of 2017 (3) dt.18-03-2017 2/2 of carrying or possessing the narcotic drugs by the petitioner and the fact that the petitioner has stated on oath that he has got no criminal antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Hajipur Sadar P.S. Case No. 377 of 2016 to the satisfaction of the Additional Sessions Judge I-cum Special Judge, N.D.P.S., Vaishali at Hajipur, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case and if the Court below would come to notice that the petitioner has committed similar type of offence in future, the Court below shall be at liberty to cancel the bail bond of the petitioner in this case also.
