Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Runnisaidpur P.S. Case No. 247 of 2018, registered for the

Patna High Court CR. MISC. No.10688 of 2022(2) dt.13-09-2022 2/3 offences punishable under Sections 147, 354, 323, 504, 324, 307, 506 of the Indian Penal Code.

As per allegation, petitioner No. 1 forcibly lifted Rekha Kumari, the sister-in-law of the informant. When the informant and her family members protested the six accused persons including the petitioners assaulted the family members of the informant.

Learned counsel for the petitioners has submitted that Rekha Devi filed a petition in the Court of CJM, Sitamarhi which is Annexure-5 and in that petition she has denied the occurrence.

Learned counsel for the petitioner has also submitted that petitioner No. 3 has also lodged a case against the members of prosecution side which is Runnisaidpur P.S. Case No. 277 of 2018.

Considering the above-mentioned facts and circumstances and also considering that Rekha Kumari has denied the occurrence, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial

Patna High Court CR. MISC. No.10688 of 2022(2) dt.13-09-2022 3/3 Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 247 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
