Petitioner is languishing in custody since 01.08.2015 in a case registered for the offences punishable under Sections 18, 20, 22 of the Narcotics Drugs and Psychotropic Substances Act.

The prosecution case is that on information that ganja is being transported through bus, a raid was laid, when one person escaped from the scene throwing the bags, four persons were apprehended with four bags namely Umesh Sah, Santosh Sah, Amardeo Sah and the petitioner. Subsequently, one bag which was thrown by the escaped co-accused was also recovered. From all the bags 4 K.gs each total weighing 20 K.gs ganja were recovered.

Patna High Court Cr.Misc. No.1795 of 2016 (3) dt.19-02-2016 It is submitted by the learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case. Even assuming the recovered quantity is only 04 K.gs which is slightly more than small quantity, statement has been made in para-3 of the petition that petitioner has no criminal antecedent and investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bettiah, West Champaran in connection with Bettiah Muffasil P.S.
