The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 41(i) of Bihar Prohibition and Excise Act.
86.4 liters of illicit foreign liquor has been recovered from the pick-up van of this petitioner. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and petitioner has been made accused only due to the fact that he is registered owner of the vehicle in question. It is further submitted that without his knowledge or consent, the pick-up van was being used in transportation of illicit liquor. Petitioner has no criminal antecedent.
