JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 This is an application for grant of anticipatory bail in connection with Chakand P.S. Case No. 128 of 2018, disclosing offences under Sections 323, 341, 325, 379, 427, 504, 506/34 of the Indian Penal Code and later on added Section 302 of the Indian Penal Code.

Allegation against the petitioners and other accused persons is of assaulting the deceased by lathi and danda causing injury and after three days, the deceased succumbed to the injury.

Submission of learned counsel for the petitioners is that there is general and omnibus allegation against the

Patna High Court CR. MISC. No.12247 of 2019(2) dt.27-02-2019 2/2 petitioners and the postmortem report does not show the cause of death.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioners stating that from impugned order it appears that three injuries were found on the person of the deceased and there is allegation of assault against the petitioners.

Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners, rather they should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
