Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Salkhua P.S. Case No. 87 of 2021 lodged under Sections 341, 323, 326, 302, 506/34 of the I.P.C.
Learned counsel for the petitioner submits that the bail petition was earlier rejected by this Court on 17.08.2022. He submits that charge has been framed but witnesses has not been examined, till date. Report has called for in this case. In the report it has come that 13 prosecution witnesses are there in the charge-sheet, out of which 1 prosecution witness has been examined and rest prosecution witnesses are yet to be examined.
Patna High Court CR. MISC. No.11272 of 2023(3) dt.29-03-2023 2/2 Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.
With this observation, the bail application stands rejected.
Trial court is directed to expedite the trial within nine months.
