However, from the perusal of the order impugned, it appears that a proceeding under Section 144 of the Code of Criminal Procedure, at the instance of opposite party no. 2, has been converted into one under Section 145 Cr.P.C. The reason assigned by the learned Sub-Divisional Magistrate, Samastipur is that both the parties have staked their claim regarding possession over the disputed plot of land. There does not appear to be any anomaly in the order for this Court to interfere with the same.
