JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code and Section 3 of the Damage to Public Property Act.
The prosecution case is that the informant being the junior engineer came to know that the petitioner is making construction on the land of housing board.
It is submitted by the learned counsel for the petitioner that on hearsay information the case has been lodged. The petitioner has no concern with the land in question and the housing board may remove the construction on the land in question.
Patna High Court Cr.Misc. No.4308 of 2016 (2) dt.01-02-2016 2/2 Statement has been made in paragraph 8 of the petition to this effect.
Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Rajeev Nagar P.S. Case No. 275 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Dinesh Kumar Singh, J.) Vinita/- U T
