This modification application is being filed for modification of order dated 04.04.2018 passed in 13091 of 2018, by which, the petitioner and one Surendra Singh were granted privilege of anticipatory bail with direction to surrender in the court below within a period of six weeks, however, the petitioner could not surrender within the aforesaid period as he was suffering from jaundice from March 2018 to September 2018 and prayed that further time may be granted to the petitioner to surrender in the court below.

Considering the facts and circumstances of the case, it

No.23818 of 2019(2) dt.17-04-2019 2/2 appears that the order was passed in the month of April 2018 and the present modification application application has been filed in the month of February 2019, as such, the plea taken by the petitioner does not appear tobe genuine, as such, I am not inclined to modify the order dated 04.04.2018 passed in 13091 of 2018. However, the petitioner, if so desire, may surrender before the court below and pray for regular bail and if any such application is filed the court below after considering the fact that earlier the petitioner was granted privilege of anticipatory bail, shall dispose of the application of the petitioner, without being prejudiced by the order of this Court.

Accordingly, this modification application is dismissed.
