JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no.2 and some others were caught on suspicion by the informant and mobile, one PAN Card and some cash are said to have been recovered from conscious possession of petitioner no.2. The petitioner and other apprehended accused disclosed that some persons were sitting in a vehicle outside the Bank premises and after that petitioner no.1 and one another person was arrested from a vehicle and after search, two notes of Rs.500/- were recovered from possession of petitioner no.1 and between the aforesaid two notes, some plain papers giving colour of notes were also recovered.

Patna High Court Cr.Misc. No.1502 of 2016 (2) dt.15-01-2016 2/2 Contention on behalf of the petitioners is that no person claimed about the cheating and recovery of the aforesaid articles does not constitute an offence against the petitioners. Considering the aforesaid facts and circumstances as well as submission of the parties and also taking note of the fact that petitioners do not have any criminal antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Gaya in connection with Civil Line P.S. Case No.395 of 2015.
