2. In the present case, the petitioner is apprehending his arrest in connection with Aandar P.S. Case No. 157 of 2023, registered on 23.07.2023 for the offences under Sections 307, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, the informant was threatened on phone by co-accused Shivam Singh that he would kill him. In the same night, the petitioner and other -accused persons ridding two motorcycles called out the brother of the informant and co-accused Shivam Singh fired upon him.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.14624 of 2024(2) dt.14-03-2024 2/3 the petitioner is having clean antecedent and there is no specific allegation or any overt act against him. The petitioner has falsely been implicated in this case though it is apparent from the FIR that the allegation is mainly against co-accused Shivam Singh who called the informant on phone and also fired upon his brother. The name of the petitioner was dragged in this case due to enmity and village politics.

5. Learned APP opposes the submission made on behalf of the petitioner. .

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the clean antecedent of the petitioner along with vague nature of allegation and possibility of false implication, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Siwan/concerned court in connection with Aandar P.S. Case No. 157 of 2023, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and other following conditions :

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
