2. The present application has been preferred for the following relief(s):

i. to Issue appropriate Writ(s), Order(s) or Direction (s) to the Respondent Authorities to pay the compensation to the petitioners in accordance with the prevalent market value rate accrued upon due to the inordinate delay caused for non-payment of

Patna High Court CWJC No.3496 of 2026(4) dt.13-07-2026 2/3 a single dime for the 5 acre 44.4 decimal of lands acquired by the Respondent Authorities under the Lease Perpetuity scheme (2014) along with all the consequential interest amounts in accordance with the Social Impact Assessment (SIA) report prepared/published and submitted before the Respondent Authorities by Chandragupta Institute of Management, Patna (CIMP) after a thorough and in-depth study as per the notification issued by Collectorate, Samastipur, with regard to the acquisition Rehabilitation / Re-Settlement and compensation be given to the petitioners.

ii. To issue appropriate Writ (s), Order(s) or Direction(s) to the respondent authorities to pay the additional interest @ 15% for the non-payment of compensation amount as per the (SIA) report submitted by the Inspecting Agency viz. Chandragupta Institute of Management, Patna.

iii. To pass any other appropriate Writ (s), Order (s), or Direction (s) to the Respondent Authorities that this Hon'ble Court may deem fit on the facts and in the circumstances of the case.

3. A counter affidavit has come on behalf of the respondent nos. 3 and 4 and learned State Counsel has taken this Court to paragraph 9 to show that those who appeared which

Patna High Court CWJC No.3496 of 2026(4) dt.13-07-2026 3/3 included the petitioner no. 2, Dilip Kumar Mandal and petitioner no. 3, Hare Ram Mandal and have submitted necessary documents, received compensation. No paper was submitted by petitioner no. 1, Vijay Bahadur Singh.

4. Learned counsel for the petitioners submit that they have another grievance regarding the categorization of the land.

5. Learned State Counsel submits that this is a separate issue which can be agitated before an appropriate authority.

6. In that background, the writ petition is disposed of allowing the petitioner no. 1 to approach the concerned authority along with all the relevant documents and if found in order, payment has to be made within a period of two months from the date the petition is handed over in the office of the respondents.

7. So far as the other claim of the categorization is concerned, the petitioners are free to approach the appropriate authority who shall be passing an order in accordance with law. (Rajiv Roy, J) Vijay Singh/- U
